1. LICENCE
When You, the user (“You”), use the Site, Sat-Insta (“Sat-Insta” or “We”) grant a limited revocable licence to You to use the Site solely on behalf of Yourself or Your organization or company for personal, non-commercial use and solely in compliance with these Terms and Conditions of Use. No right, title or interest in any downloaded materials or software is transferred to You. This licence expressly prohibits You, without limitation, from reselling the Site or any portion thereof or the services offered by Sat-Insta, making any derivative work of the Site, collecting or using e-mail addresses or other information, ratings or listings, or extracting or mining any data whatsoever. You may use this Site for legitimate informational and shopping purposes only. Sat-Insta has made every attempt to ensure that the services available are acquired to meet the needs of all Sat-Insta’s customers. Sat-Insta cannot confirm the price of a quotation given will be accurate until the engineer has attended the appointment. Prices are subject to change without notice.
3. REGISTRATION AND PASSWORD
In the event that You register and/or requested call back services, request an online quote, make a booking or pay for installation services and service contracts through this Site, You agree to provide true, accurate, current and complete information about Yourself as prompted by the registration form. If You provide any information that is untrue, inaccurate, not current or incomplete, or Sat-Insta suspect, for any reason, that such information is untrue, inaccurate, not current or incomplete, Sat-Insta, in its sole discretion, have the right to suspend or terminate Your contract or account, refuse to complete the request or issue a service contract and refuse any and all current or future use of the Site by You. Sat-Insta will not be liable for any loss or damage arising from Your failure to comply with this paragraph or the exercise of any rights under these Terms and Conditions of Use.
4. LINKS TO OTHER SITES
References on this Site to any name, marks, products or services of third parties or hypertext links to third party sites or information are provided solely as a convenience to You and do not in any manner constitute or by way imply an endorsement, sponsorship or recommendation by Sat-Insta’ regarding the third party information, product or service. These sites are maintained by third parties over whom Sat-Insta exercise no control. Sat-Insta have not reviewed all sites linked to this Site and Sat-Insta expressly disclaims any responsibility for the content, the accuracy of the information, and/or the quality of products or services provided by or advertised on these third-party web sites. In addition, Sat-Insta will comply with all court orders involving requests for such information. 11. GOVERNING LAW
This Site (excluding any links) is owned and controlled by Sat-Insta. ("Sat-Insta") from its office within England. Although this Site can be accessed from other locations, by accessing this Site, You agree to the English Law, without regard to conflict of laws, will apply to all matters relating to use of this Site. In addition, any action or proceeding arising out of or related to these Terms and Conditions of Use or Your use of this Site initiated by You may be brought only in English Courts and You agree to and consent to the exclusive personal jurisdiction and venue of the courts in England. You are responsible for Your own compliance with local laws regarding Internet use and access.
12. SERVICE CONTRACTS
The issuing of Service Contracts are subject to satisfactory completion of an initial service inspection by a Sat-Insta registered engineers.
All Service Contracts run for a minimum period of 12 months from the Start Date.
The service contracts do not cover 3rd party damage and/or any parts which were not supplied/installed by Sat-Insta on the date of the contract agreement being signed.
13. TERMINATION OF SERVICE CONTRACT
Sat-Insta reserve the right to cancel the Service Contract subject to Conditions
Sat-Insta may cancel the Service Contract at any time if:-
a) You have given us false or misleading information.
b) You do not make an agreed payment when due.
c) Following a site visit by one of our engineers, you do not follow our recommendation to repair an existing fault.
d) Excessive use of call out service
e) Excessive use of technical Support.
- After the expiry of the Initial Term, we may, at our discretion, refuse to offer renewal of any Service Contract.
- We will write to you before the termination or expiry of the Service Contract to notify you regarding termination, expiry, renewal charges, or any change in our prices for the following twelve-month period.
You are entitled to a full refund if you cancel your Service Contract within 7 days from the Start Date providing no work/technical support/advice has been carried out/given on your satellite system.
You may cancel your Service Contract at any time after that, but a refund will not normally be given. If you wish to cancel your Service Contract, you must inform Sat-Insta by writing.
14. MISCELLANEOUS
These Terms and Conditions of Use constitute the entire agreement between You and Sat-Insta relating to the subject matter addressed herein. The Terms and Conditions of Use may be modified by Sat-Insta at any time or without prior notice, by posting such changes at the Site. Modifications required by law or designated by Sat-Insta will become effective immediately. Your continued use of the Site following notice of any such modification will be conclusively deemed Your unconditional acceptance of the revised Terms and Conditions of Use. If any such revision is unacceptable to You, You should discontinue use of the Site immediately. A printed version of these Terms and Conditions of Use and of any notice given in electronic form will be admissible in judicial or administrative proceedings based on or relating to these Terms and Conditions of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. The failure of Sat-Insta to act with respect to a breach of this Agreement by You or others does not constitute a waiver and shall not limit Sat-Insta’ rights with respect to such breach or any subsequent breaches. |
